  WHAT IS A BUYERS AGENT?

Fiduciary adj (fiduciarius, fr. fiducia confidence, trust, fr. fiderel (1641): of, relating to, or involving a confidence or trust; as a: held or founded in trust or confidence b: holding in trust c: depending on public confidence for value or currency (- fiat money)

A buyer agency contract creates legal fiduciary responsibilities between the buyer and the agent. The responsibilities are:
  • Loyalty to the buyer's interests
  • Obedience to the buyer's wishes
  • Disclosure of useful information
  • Confidentiality in all matters
  • Reasonable care and diligence
  • Accounting on all matters
Unless you and your real estate agent are working under a "buyer agency" contract, the selling agent is: obligated to obtain the highest price for the seller, and serve the best interests of the seller, not the buyer.
